Adultery & Rape : Sharia Law


Hierarchy of authorities of Sharia Law:
1) Quran
2) Hadith
3) Scholars

The method of checking the authenticity of a Hadith:

1) If a Hadith goes against the Quran, Muslims do not follow that Hadith (The chains of narration of that Hadith don't count).

2) If a Hadith matches with Quran, Muslims follow that Hadith (The chains of narration of that Hadith count).

3) If Quran says to do a task not mentioning how to carry that out and Hadith says to do the same task mentioning how to carry that out, Muslims follow the way that Hadith says to carry that out (The chains of narration of that Hadith count).

4) If Quran is silent about what a Hadith says, Muslims follow that Hadith (The chains of narration of that Hadith count).

Quran doesn't say to kill adulterers and rapists. Therefore, Muslims don't accept Hadith that go against Quran about the punishment of illegal sexual intercourse. Quran says-"The woman and the man guilty of illegal sexual intercourse, flog each of them with a hundred stripes. Let not pity withhold you in their case, in a punishment prescribed by God, if you believe in God and the Last Day. And let a party of the believers witness their punishment" (Quran 24:2). It's clear in the Quran that illegal sexual intercourse (adultery, rape, etc.) is punished by 100 stripes, not by stone to death penalty.

How do we know that Hadith that contradicts Quran isn't authentic? Quran says-" This is the Book about which there is no doubt, a guidance for those conscious of God" (Quran 2:2). It's clear from this verse that Quran is authentic. Therefore any Hadith that contradicts Quran is unauthentic.

What is the proof that prophet Muhammad (sw) didn't disobey Quranic Law when judging people & giving sentences? Quran says-"Most surely, it is the Word brought by an honored Messenger [Mohammad], And it is not the word of a poet; little do you believe. Nor the word of a soothsayer; little do you remember. [This is] a revelation from the Lord of the worlds. And if he [Mohammad] had fabricated against Us some of the sayings, We would certainly have seized him by the right hand, Then We would certainly have cut off his aorta." (Quran 69:40-46)

Quran also says-"Whenever Our authoritative revelations are recited to those who do not wish to meet Us in the life hereafter, say, "Bring us another book besides this one or change it." (Muhammad), tell them, "I cannot change it myself. I ONLY FOLLOW WHAT IS REVEALED TO ME. I fear that for disobeying my Lord I shall be punished on the great (Day of Judgment)" (Quran 10:15). It is clear from these verses that Prophet Muhammad (sw) is unable to change the message of Quran or act against Quran. Therefore, any Hadith that says Prophet Muhammad (sw) gave sentences that went against Quran is unauthentic.
